This Refund Policy outlines the conditions under which KSSW Services LTD ("we," "us," or "our") may provide refunds for our landscaping services. By hiring us, you agree to this policy.
1. General Policy
We take pride in the quality of our work and our commitment to customer satisfaction. However, because our services involve labor, living materials, and site-specific conditions, our refund policy is designed to be fair while protecting our business.
2. Non-Refundable Services and Deposits

Deposits: All project deposits are non-refundable. These deposits cover the initial costs of project planning, design, scheduling, and the purchase of materials.

Completed Work: Payments for services that have been completed as per the agreed-upon scope of work are non-refundable.

Plant and Turf Material: As living materials, plants and turf are subject to environmental conditions beyond our control. We offer a limited warranty on these materials (as detailed in your contract or terms and conditions), but we do not provide refunds for their failure due to improper watering, neglect, or extreme weather conditions.
3. Eligibility for a Refund
A client may be eligible for a partial refund or service credit under the following circumstances:

Failure to Perform: If we are unable to complete the work as specified in the agreed-upon contract and the failure is directly due to our negligence or error.

Major Deficiencies: If the completed work contains significant defects that deviate from industry standards and the agreed-upon scope of work.
4. How to Request a Refund
All refund requests must be submitted in writing within 7 days of the project's completion or the service date. The request must include:

Your name, contact information, and the project address.

A clear explanation of the issue and why you are requesting a refund.

Supporting documentation, such as photographs of the alleged defects.

5. Refund and Dispute Resolution Process

Review: We will review your request and may schedule a site visit to assess the issue within 5-10 business days.

Resolution: If we determine that a deficiency or error occurred on our part, our primary solution will be to correct the issue at no additional cost to you.

Partial Refund/Service Credit: If a resolution cannot be reached by correcting the work, we may offer a partial refund or a service credit for future work at our sole discretion. The refund amount will be proportional to the value of the uncompleted or deficient work.
6. Exceptions

Client Changes: We are not responsible for work that is not completed or needs to be redone due to changes requested by the client after the project has started. These changes will be billed as a separate service.

Damages by Third Parties: We are not responsible for damages or issues caused by third parties, including but not limited to other contractors, utility companies, or animals.

Failure to Maintain: We are not responsible for the failure of plants, turf, or other installations if the client does not follow the provided maintenance instructions.
